Monday, January 5, 2009   11:00 a.m.

The Board of County Commissioners convened today to organize for the year 2009.  All members present.  

  

On motion of Comm. Carpenter, seconded by Comm. Litz, Commissioner Stohler was elected Chairman of the Board .  Vote unanimous.

   

On motion of Comm. Stohler, seconded by Comm. Carpenter, Commissioner Carpenter was elected Vice-Chairman of the Board.  Vote unanimous.

 

 On motion of Comm.  Stohler, seconded by Comm. Carpenter, Commissioner Litz was elected Secretary of the Board.  Vote unanimous.

 

 On motion of Comm. Litz seconded by Comm. Carpenter, Jamie A. Wolgemuth was re-appointed County Administrator to the Board of County Commissioners for the year 2009.  Vote unanimous.

 

 On motion of Comm. Carpenter, seconded by Comm. Litz , Attorney Adrienne C. Snelling was re-appointed Solicitor to the Board of County Commissioners for the year 2009.  Vote unanimous.

On motion of Comm. Carpenter, seconded by Comm. Litz to re-appoint all employees on the County payroll to their respective positions, effective January 1, 2009.  Vote unanimous.

  

On motion of Comm. Carpenter, seconded by Comm. Stohler to approve the following schedule for meetings of the Board of Commissioners for the year 2009:   Notice to be posted and advertised in accordance with the law.   Comm. Carpenter and Comm. Stohler voted “Aye”, Comm. Litz voted “Nay”.  Motion carried.

  

                                                          PUBLIC NOTICE

  

The Lebanon County Commissioners will hold regularly scheduled meetings to transact county business on the following days for the Year 2009.

  

Ø  Every Thursday in Room 207 of the Municipal Building, Lebanon, Pennsylvania beginning at 9:30 a.m. and continue until all business is transacted.   If a holiday falls on Thursday, then the meeting will be held on the preceding Wednesday.  In the event the holiday falls on a Wednesday, there will be only one meeting held this week on Thursday following the Wednesday holiday.

  

Ø  The third Wednesday of each month at the Lebanon County Nursing Home, Cedar Haven, beginning at 10:30 a.m. and continue until all business is transacted.

  

Ø  The Commissioners will meet on all other Wednesday, beginning at 9:30 a.m. in Room 207 of the Municipal Building and from time to time thereafter during the day until the close of business at 4:30 p.m. for the purpose of work sessions dealing with county government functions.

 

 Ø The Thursday following the fourth Saturday in July, the Commissioners meeting will be held at the Lebanon Valley Expo Center & Fairgrounds, 80 Rocherty Road, Lebanon, PA 17042 beginning at 9:30 a.m. and continue until all business is transacted.

  

Individuals, committees or groups wishing to meet with Board of Commissioners are requested to call the office at 274-2801 extension 2202 prior to the date of the meeting to arrange for an appointment.   Meetings arranged by appointment will be given priority to avoid unnecessary delay.

  

The Lebanon County Salary Board will meet during the regularly scheduled meeting of the County Commissioners every Thursday in Room 207 of the Municipal Building, Lebanon, Pennsylvania unless a holiday falls on Thursday then the board will meet immediately following the meeting on the preceding Wednesday.

Thursday, January 8, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.  Comm. Stohler presiding.

 

The meeting opened with the Pledge to the Flag.

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report withh expenditures in the amount of $1,715,282.13.

  

Eugene Mavretic resigned as a member of the County of Lebanon Transit Authority (COLT) Board. 

  

Allen Freed and Brenda Wurges, were reappointed members of the County of Lebanon Transit Authority (COLT) Board with terms to end January 31, 2012.   

  

The Commissioners appointed the following individuals as members of the Local Emergency Planning Committee (LEPC) for the Emergency Management Agency:  The names will be forwarded to the Pennsylvania Emergency Management Agency (PEMA) as official representatives of Lebanon County.

A t 9:50 a.m. the Commissioners called a recess.

 

At 10:00 a.m., the Commissioners reconvened the meeting.

 

A Public Hearing on the Section 108 Boscov’s Department Stores, LLC Project.  There were six (6) people from the public in attendance, which included Representative Rose Marie Swanger.   The following individuals made comments and a lengthy discussion followed: 

The Commissioners closed the hearing.  

  

The Commissioners approved the proposal and to adopt the following Resolution No. 1-8-09 to approve and authorize the submission of an application for Section 108 Loan Guarantee Funds:

  

                                             RESOLUTION NO. 1-8-09 of 2009

 

RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE COUNTY OF LEBANON APPROVING AND AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR SECTION 108 LOAN GUARANTEE FUNDS

 

WHEREAS, the Commonwealth of Pennsylvania has developed a program for the use of Section 108 Loan Guarantee funds in accordance with Federal Regulations; and

  

WHEREAS, public entities may apply for Section 108 Loan Guarantee funds through the Commonwealth of Pennsylvania ; and

  

WHEREAS, under the PA Section 108 Loan Guidelines, funds must be used for eligible activities which benefit low-and moderate-income persons; and

  

WHEREAS, the County of Lebanon has held public hearings to receive input on the proposed use of Section 108 Loan funds; and

  

WHEREAS, funding is needed to finance an asset purchase transaction in order to preserve the financial viability of the Boscov’s Department Store chain (“the Boscov’s Project”); and

  

WHEREAS, the Boscov’s Project will primarily benefit low-and moderate-income persons in the County of Lebanon ; and

  

WHEREAS, the Commonwealth of Pennsylvania, through the Department of Community and Economic Development’s PA Section 108 Loan Program, will make the payments necessary to insure that the County of Lebanon will not lose its available Community Development Block Grant (“CDBG”) allocation as a result of the County’s participation in the Boscov’s Project.

  

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF LEBANON, PENNSYLVANIA, that it hereby approves the filing of this application for a Section 108 Loan Guarantee in the amount of $5,833,333; and

  

BE IT FURTHER RESOLVED, that the County of Lebanon shall loan the Section 108 Loan proceeds to Boscov’s Department Stores, LLC; and

  

BE IT FURTHER RESOLVED, that the Chairman of the Board of Commissioners of the County of Lebanon is authorized to sign and is directed to file this application, including all assurances and certifications with the PA Department of Community and Economic Development.

  

BE IT FURTHER RESOLVED, that the Chairman of the Board of Commissioners of the County of Lebanon is hereby authorized to execute a Contract for Loan Guarantee Assistance under Section 108 of the Housing and Community Development Act of 1974, as amended, and such promissory note, loan agreements, and other instruments and documents as may be necessary to effectuate the foregoing purposes.

 Thursday, January 15, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.  Comm. Stohler presiding.

  

The meeting opened with the Pledge to the Flag.

 

 Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report withh expenditures in the amount of $3,276,091.42. 

  

This week’s net payroll is in the amount of $1,035,523.88.

The Commissioners approved and signed the Pennsylvania Commission on Crime and Delinquency (PCCD), an application for the Gatekeeper Program in the amount of $11,112.00 for the period of April 1, 2009 to March 31, 2010.  The funds will be used for an eight panel program in which first time juvenile offenders are given the opportunity to complete a program, which if completed successfully will result in the juveniles criminal charges being dismissed.  

  

The Commissioners approved and signed the Department of Conservation and Natural Resource County/Municipal Cooperative Agreement for the 2009 Gypsy Moth Suppression Project.  3,292 acres will be treated with a single application of Bt at a dose of 38 BIUs per acre at a cost of $21.00 per-acre cost-sharing rate.  

  

The Commissioners approve the sale from the Repository for Unsold Properties to Wilma Via, 1612, Sandhill Road, Lebanon, PA on property located at 20 Lakeside Park, Lebanon, PA  17046, district/map & lot #27:2330074-375837-0984 (Mobile Home) in the bid amount of $1.00. 

  

It was moved by Comm. Litz to appoint Fred Goudy as a member of the County of Lebanon Transit Authority Board of Directors.  Motion died for lack of second.

  

It was moved by Comm. Stohler, seconded by Comm. Carpenter to appoint Joseph Eisenhauer as a member of the County of Lebanon Transit Authority Board of Directors with a term to end January 31, 2012.  Comm. Stohler and Comm. Carpenter voted “Aye”, Comm. Litz voted “Nay”.  Motion carried.

  

The Commissioners approved and signed an updated letter to extend Lebanon County ’s commitment of funds from the Affordable Housing Trust Fund for the Mifflin Mills project on North 7th and Mifflin Streets in the City of Lebanon .  The commitment is in the amount of $500,000 toward the development of twenty (20) new three-bedroom affordable townhomes.  

 

 It was moved by Comm. Litz to conduct a Commissioners meeting one night each month.  Motion died for lack of a second. 

  

It was moved by Comm. Litz to open the Commissioners meetings with prayer.  Motion died for lack of a second.

  

It was moved by Comm. Litz to research broadcasting the Commissioners meeting on the Internet.  Motion died for lack of a second.

At 1:30 p.m. the Commissioners sat as the County Board of Assessment to hear assessment appeals.

  

Wednesday, January 21, 2009   10:30 a.m. 

The regular meeting of the County Commissioners was held today at Cedar Haven.  Comm. Carpenter absent.  Comm. Stohler presiding.

 

The Commissioners asked for public comment and no comments were heard.

Edward Schlegel, Administrator of Cedar Haven, met with the Commissioners to discuss the business matters of Cedar Haven.

  

The occupancy rate at the facility is at 95% capacity.

The Commissioners approved the replacement of a control valve in Elevator #4 at an estimated cost of $12,000.00. 

 

 Cedar Haven received four (4) out of five (5) stars from the Federal Center for Medicare and Medicaid Services in a recent survey.  Results of the ratings were published in the December 19, 2008 edition of the Harrisburg Patriot News.

At 12:00 noon, the Commissioners met with other members of the Prison Board to conduct their monthly meeting.  

 

 Thursday, January 22, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.  Stohler presiding.

  

The meeting opened with the Pledge to the Flag.

  

The Commissioners approved the minutes the previous meeting. 

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report.

The Commissioners moved to accept the Treasurer’s report with expenditures for $1,833,204.26.

  

The Commissioners approved and signed the Certification of County Maintenance Effort. Whereas, pursuant to Section 254(a) of Help America Vote Act and in accordance with its agreement for HAVA Title II Financial Assistance with the Commonwealth of Pennsylvania, Lebanon County certifies that it has maintained its level of expenditures (as identified in Element No. 7 of the County Plan) for the administration of voting programs at a level that is not less than the level of such expenditures maintained by the County for the fiscal year ending prior to November of 2000.  This certification is for the reporting period of January 1, 2008 through December 31, 2008.  The level of expenditures required in the County Plan, Element No.7 equals $181,680 and the level of expenditures, current report period equals $321,046.69. 

  

The Commissioners approved and signed the 1st quarter Reimbursement Request and Performance Report (HAVA Grant-Section 261). The expenditures to date are $7,588.63.  The reimbursement requested for this report is $243.96 for the reporting period of October 1 – December 31, 2008.

  

At 9:45 a.m., the Commissioners sat as the County Board of Elections.

  

At 9:47 a.m., the Commissioners reconvened the regular meeting.

  

Dr. Jeffrey Yocum, Lebanon County Coroner, met with the Commissioners to present his annual State of the Coroner’s Office report for 2008.

Thursday, January 29, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.  Stohler presiding.

  

The meeting opened with the Pledge to the Flag.

  

The Commissioners approved the minutes the previous meeting.

  

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report.

The Commissioners moved to accept the Treasurer’s report with expenditures for 3,033,626.40. 

This week’s net payroll is in the amount of $1,012,838.96.  

 

Daniel Kauffman, Director and Benjamin Herskowitz, HazMat Chief of the Lebanon County Emergency Management Agency, met with the Commissioners to present the Lebanon County Hazardous Materials Emergency Response Preparedness Assessment Update for calendar year 2007.     

 

Commissioner Stohler presented a list of items he would like to have corrected in the Hazardous Materials Emergency Response Preparedness Assessment Report and asked these gentlemen to report back with the correct information in place.

  

At 10:10 a.m., the Commissioners along with the County Controller and County Treasurer sat as the County Retirement Board.

 

 Archie Battistelli, Vice President and Michael Battistelli of Stifel Nicolaus & Company, Inc., Lebanon, PA met with the Board to present the 4th quarter retirement report.

  

At 10:30 a.m., the Commissioners reconvened the meeting.

 

The Commissioners approved and signed a letter of support of for the funding request by North Londonderry Township through Pennsylvania’s H2O PA Program for the planned wastewater treatment plant (WWTP) upgrade.  This project will provide increased capacity and efficiency to current users within North Londonderry Township and the Borough of Palmyra, while also satisfying compliance requirements set forth in the Chesapeake Bay Tributary Strategy.  Funding for this $17.4 million public utility improvement will allow for increased capacity, providing for potential residential and commercial expansion throughout the region. 

  

The Commissioners approved and signed the Pennsylvania Department of Transportation, Bureau of Municipal Services, the 2009 Report of County Liquid Fuels Tax Funds for Lebanon County.  The unencumbered balance at the close of this period is $67,867.12. 

  

The Commissioners approved the sale from the Repository for Unsold Properties to Kim Rollins, 1800 Coon Creek Road, Palmyra, PA 17078 on property located at 220 Melanie Lane, Jonestown, PA, district/map & lot #33:23059873 (Mobile Home) in the bid amount of $1.00. 

  

The Commissioners approved and signed the annual Web Services Program Agreement between the County of Lebanon and the Commonwealth of Pennsylvania, Office of Administration, Office for Information Technology (OA/OIT) and Peripherals Plus Technologies, Inc. (PPT, Inc.), Lancaster, PA.  This agreement is for Web Hosting Fees for $1,320.00 and Web DSF Membership Fees for $1,886.00. 

  

The Commissioners approved and signed a four (4) year Lease Agreement between the County of Lebanon and Dell Financial Services for products, services, and software at the annual rent payment amount of $22,358.10. 

  

The Commissioners adopted a proclamation to proclaim the week of February 1-6, 2009 as “BOY SCOUT WEEK” in Lebanon County, Pennsylvania.  We call upon all the citizens of Lebanon County to join us in extending sincere congratulations to the Boy Scouts of America on its ninety-ninth year of service to the United States of America.  FURTHER, we commend the community groups that provide volunteer adult leaders who make it possible for the scouting program to bring its proven benefits to our young people.

 
The Commissioners adopted a proclamation for Kyle Pennypacker, to unite with the scouts, leaders and committee members of Boy Scout Troop 412 to recognize “Kyle” for all his outstanding accomplishments.  FURTHER, we extend congratulations to Kyle for attaining the rank of Eagle Scout and wish him continued success in all his future endeavors.
