Thursday, September 3, 2009   9:30 a.m.
 

The regular meeting of the County Commissioners was held today, all members present.

Comm. Stohler presiding. 

 

The meeting opened with the Pledge to the Flag. 

 

The Commissioners approved the minutes the previous meeting.

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report with expenditures for $918,559.98. 

 

At 9:40 a.m., the Commissioners sat as the County Board of Elections.

  

At 9:43 a.m., the Commissioners reconvened the regular meeting. 

 

The Commissioners approved a Resolution to recognize Ken Keener, resident of Annville Township, Lebanon, Pennsylvania .  Mr. Keener will be honored as the “CLA 2009 Business Person of the Year” on September 9, 2009.  Mr. Keener is the 3rd generation in a poultry related business, Mr. Keener is the owner, operator of Keener Poultry in the Lebanon Farmers Market for over twenty years.

 

The Commissioners accepted and signed the CY 2010-2011 Integrated Children’s Service Plan (ICSP) on behalf of the child-serving departments.  The Lebanon County Children’s Service Planning Committee (CSPC) is a fully functional, very effective, coordinated, and cooperative group consisting of the Mental Health/;Mental Retardation/Early Intervention Program (MH/MR/EI), Children & Youth (C&Y), Drug and Alcohol (D&A), Child and Adolescent Service System Program (CASSP) and the Juvenile Probation Office (JPO). 

 

Jamie Wolgemuth, County Administrator and Attorney Peter Edelman of Stevens & Lee, Bond Counsel met with the Commissioners to discuss a line of credit on behalf of the County of Lebanon in the event that the County needs operating funds due to the State’s budget impasse. 

 

The Commissioners approved and signed the line of credit commitment letters from Jonestown Bank & Trust Co. and First National Bank of Fredericksburg for the County to borrow $4,000,000.00 at the prime rate of 4%.  The principal payable will mature on December 31, 2009. 

 

The Commissioners adopted Resolution #9-3-09 to authorize $4,000,000 Tax and Revenue Anticipation Note Series A of 2009 Dates September 3, 2009.    This  Tax and Revenue Anticipation Note, Series A of 2009 (the “Note”), is authorized and issued in the principal amount of $4,000,000 in accordance with the provisions of the Local Government Unit Debt Act of the Commonwealth, as codified by the Act of December 19, 1996, P.L. 1158, No. 177 (the “Act”), and pursuant to a resolution, dated September 3, 2009 (the “Resolution”), duly adopted by the County and filed, together with other required documents, with the Pennsylvania Department of Community and Economic Development.  Reference is hereby made to the Act and the Resolution for a complete statement of the rights and limitations of rights of owners of the Note, to all of which the owner hereof by acceptance of this Note assents.

Thursday, September 10, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.

Comm. Stohler presiding.

  

The meeting opened with the Pledge to the Flag. 

 

The Commissioners approved the minutes the previous meeting.

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report with expenditures for $3,588,334.49. 

This week’s net payroll is in the amount of $1,015,493.75.

 

At 9:40 a.m., the Commissioners sat as the County Board of Elections.

 

At 9:43 a.m., the Commissioners reconvened the regular meeting.

  

The Commissioners approved and signed the PennDOT DUI Court Grant 2009-2010 Budget Modification for the Lebanon County D.U.I. Court Program in the amount of $147,560. 

 

Commissioner Carpenter proposed that Lebanon County stop sending county-collected funds to the Commonwealth and place the funds instead in an escrow account to draw interest and possibly can be used to pay the interest on the $4,000,000 line of credit that the County established due to the State’s budget impasse.  The impasse is causing fiscal distress on County’s cash flow.  President Judge John Tylwalk stated that as long as this type of action is legal, he is in favor of it.  Commissioner Carpenter stated that he spoke to Representatives Gingrich and Swanger and the both are in favor.  Commissioner Carpenter asked the County Solicitor to research and find out if this will be legal.

 

The Commissioners adopted a resoluton to recognize Lebanon Catholic School, to recognize Lebanon Catholic School on their “150TH ANNIVERSARY” and extend congratulations to the Administration and staff as they celebrate this milestone.  Lebanon Catholic School is located on land known as Assumption Hill, 1400 Chestnut Street, Lebanon, Pennsylvania, will celebrate its 150th Anniversary of serving the Lebanon community.

Wednesday, September 16, 2009   10:30 a.m. 

The regular meeting of the County Commissioners was held today at Cedar Haven, all members present.  Comm. Stohler presiding.

 

The Commissioners asked for public comment and no comments were heard.

  

Edward Schlegel, Administrator and Marcia Krause, Assistant Administrator of Cedar Haven, met with the Commissioners to discuss the business matters of Cedar Haven.

  

The Pennsylvania Department of Health (D.O.H.) conducted an annual inspection the first week of September.  Two (2) deficiencies were noted for which correction plans were submitted to the D.O.H. 

  

The Division of Life Safety, inspected the facility on September 11, 2009 and cited two (2) minor issues that have been corrected.

  

The Fall Frolic was held on September 12th.  Attendance was good.

 

 The Commissioners authorized the Renova Center Administration to accept guardianship of Timothy Peters, Renova Resident as Timothy has no family or guardians to oversee his care.

 

Terri Kaufman, Executive Director of the South Central Workforce Investment Board (WIB), met with the Commissioners to give an update on activities of the Workforce Investment Board.  Also in attendance were Robert Gallagher, Chairman of WIB, Joseph Alsberry, Deputy Director and Barbara , Chief Financial Officer.

  

It was moved by Comm. Carpenter, seconded by Comm. Litz to adjourn the meeting.

  

At 12:00 noon, the Commissioners met with other members of the Prison Board to conduct their monthly meeting. 

  

Thursday, September17, 2009   9:30 a.m.

 The Commissioners approved the minutes the previous meeting.

  

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report with expenditures for $932,326.88.  

  

At 9:37 a.m., the Commissioners sat as the County Board of Elections.

At 9:48 a.m., the Commissioners reconvened the regular meeting.

 

The Commissioners approved and signed the Pennsylvania Emergency Management Agency (PEMA) Emergency Management Performance Grant (EMPG) application for the period of October 1, 2009 through September 30, 2010 in the amount of $275,449.51.   PEMA annually applies to the United States Department of Homeland Security (DHS) for federal Emergency Management Performance Grant (EMPG).  

  

The Commissioners approved and signed an Agreement Addendum, Implementation of the American Recovery and Reinvestment Act of 2009 (ARRA).  This agreement addendum addresses additional requirements applicable to ARRA funds.  Amendment #1 to the Program Management Agreement for the Emergency Food Assistance Program (TEFAP) and the Pennsylvania Department of Agriculture (PDA).  The Agreement provides for the responsible distribution and use of food and funds under TEFAP in accordance with guidelines established by the United States Department of Agriculture.  Lebanon County Christian Ministries is in charge of running this program for Lebanon County.

  

The Commissioners adopted a proclamation for Harlan Daubert to unite with The Northern Lebanon Board of School Directors in recognizing and congratulating Mr. Daubert for his outstanding accomplishments.   FURTHER,  We, the Commissioners of Lebanon County, do hereby proclaim Monday, September 21, 2009 as ‘HARLAN DAUBERT DAY” within the County of Lebanon in celebration of the naming of the high-school auditorium the “HARLAN A. DAUBERT AUDITORIUM”; and  to thank Mr. Daubert  for all the positive influence he has had on so many people.  

The Commissioners adopted a proclamation for Salem Evangelical Lutheran ChurchSalem Evangelical Lutheran Church located at 119 North Eighth Street, Lebanon, Pennsylvania is celebrating “two hundred fifty years” of conducting worship services in Lebanon County.

  

Attorney Adrienne Snelling, County Solicitor, stated that it is recommended, in accordance with the statue, 72 P.S. §903 for Lebanon County to continue remitting funds to the Commonwealth in light of the impasse.  The statue  provides that in the case of failure to make a return the Secretary of Revenue, any agent appointed by the secretary is authorized to examine the books and accounts and settle such account, adding a penalty of 5% per month.

Thursday, September 24, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.

The meeting opened with the Pledge to the Flag.

 

 The Commissioners approved the minutes the previous meeting.

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report with expenditures for $ 2,107,795.47. 

This week’s net payroll is in the amount of $11,055,126.62.

 

 The Commissioners approved and signed the 2nd quarterly report for Help America Vote Act (HAVA) Section 102 Funds.  The grant award amount was $35,752.18 and the remaining dollar amount is $35,752.18 for second quarter reporting period of January-March 2009.   Per the grant agreement, the request will be to offset the cost of ES&S iVotronic HAVA-complaint touch screen voting machines that were purchased in 2006. 

 

 The Commissioners approved and signed the 2nd quarterly report for Help America Vote Act (HAVA) Section 251 Funds.  The HAVA Interest-1 grant amount was $58,042.30 and the remaining grant amount is $58,042.30 for second quarter reporting period of January-March 2009.   Per the grant agreement, the request will be to offset the cost of ES&S iVotronic HAVA-complaint touch screen voting machines that were purchased in 2006.  

  

At 9:37 a.m., the Commissioners sat as the County Board of Elections.

 

 At 9:38 a.m., the Commissioners adjourned the meeting.

 

 The Commissioners reconvened the regular meeting.

  

Patrick Salmon, Account Executive, Anil Bansal, Engineer and Antone Brum, Automation Specialist of Honeywell International Inc., met with the Commissioners and presented a PowerPoint Energy & Operational Savings Assessment proposal for Lebanon County.

  

The Commissioenrs agreed to continue with the Honeywell audit for Lebanon County. 

  

Jamie Wolgemuth, County Administrator, met with the Commissioners to open the following bids received for a 38 x 24 Storage Shed/Pavilion to be erected at Union Canal Park., North Lebanon Township, PA.  James Schucker, Project Manager of Friends of Union Canal was in attendance.

The Commissioners approved to accept the low bid that meets with the specifications/requirements for a 38 x 24 Storage Shed with attached Pavilion to be erected at Union Canal Park. 

  

Chuck Killian, President and Ronald Miller, Project Coordinator of the Firefighters Association (FFA), met with the Commissioners to seek (additional) financial assistance for the repair or replacement of the burn building located at the Fire Training School.  Daniel Kauffman, Director of Lebanon County Emergency Management Agency, was in attendance and stated the importance of the FFA being able to continue to provide training in the burn building.

  

The Commissioners approved the sale from the Repository for Unsold Properties to Dale & Vanessa Brown, Harrisburg, PA on property located at 3 Brown Lane, Lebanon, PA, district/map & lot #19:2335675-409793-5399 in the bid amount of $20.00. 

 

 The Commissioners approved and signed the Pennsylvania Department of Transportation, Bureau of Municipal Services, the 2008 Report of Act 44 Tax Fund for Lebanon County.  The balance at the close of this period is $24,517.85.  

  

At 10:30 a.m., the Commissioners met in an executive session to discuss personnel matters.

  

At 1:30 p.m., the Commissioners sat as the County Board of Assessment to hear assessment appeals.
